Patent License Agreements

June 24th, 2008 · No Comments

The frustrations of inventing are many.  One has to worry about others stealing the idea, then once the idea has been protect by going through the lengthy patenting process, he must try to market the invention to companies that might be interested in replicating it and selling it to consumers.  If all this goes well, the next step is developing a Patent License Agreement.

If there is one thing to understand when drafting an agreement, it would be that for the good of the negotiation, legal counsel would probably be the best fit for mitigating the deal.  It is possible to set the terms with your patent attorney before going into the negotiation.

The agreement should cover exhaustive list of the agreement terms, including royalties, upfront monies, definitions, obligations, infringement costs and so forth.  If you need help negotiating the terms of your patent agreement, contact the patent law specialists at the Williams Kherkher law firm by calling 866.950.9000.
