What to do if your patent is rejected

June 4th, 2008 · No Comments

Rejection is one of the most difficult things for any individual to have to endure.  The emotional pain is particularly potent when that reject involves one’s own creation.  Not every patent is able to get through to the end.  However, this does not mean the end of the road for your invention.  There are numerous ways to revise your patent idea or submission for it to be reconsidered.

There are a few things you must do first.  It is important to go thoroughly through the revision process before resubmitting it.  When you receive your rejection letter, place some time between when you receive it and when you go to revise it.  In this case you can look at the project with fresh eyes and a new mode of thinking.

Then, reread the requirements for submission and issuance.  Make sure that you have not left a crucial piece of the puzzle out of the mix.  After you have done this, identify the fundamental issue that need to be address in your presentation.  Once you’ve completed these steps, consult with a patent attorney, who has experience in the field and will be able to help you further with the patenting process.
