Understanding International Patent Law

An interesting thing about patents is that they are territorial by nature. Patents are governed by national law. Each respective nation usually sets up a commission that is responsible for determining the worthiness or originality of an invention. These then must comply with the standards of international treaties.

The World Trade Organization (WTO) is particularly interested in streamlining the patent laws internationally. In fact, in order to become a member of the WTO, countries much adhere to the standards outlined in the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS).

With the advent of globalization, this movement toward internationalizing the laws under which inventions are protected might be the next step in making sure that your ideas don’t end up in the hands of someone else.
