Pharmaceutical Patent Litigation
September 21st, 2007 · No Comments
When it comes to patent litigation, most people think of an invention or maybe an idea first. But patent issues can also involve the pharmaceutical industry. This is the case with Japanese-based Daiichi Sankyo Company and their United States subsidiary in New Jersey. They are filing a patent lawsuit against Mylan Pharmaceuticals, Inc., which is headquartered in West Virginia. Daiichi Sankyo has a United States patent that covers olmesartan medoxomil or Benicar HCTÒ. This is an active ingredient in a Daiichi Sankyo antihypertensive drug. Mylan is in the process of submitting a drug that will be a generic version of Benicar HCTÒ. The patent that Daiichi Sankyo owns expires in the United States in April 2016. They are adamant about defending this patent against Mylan.
